NOTICE OF PUBLIC HEARING AND ANNUAL ELECTION

NOTICE IS HEREBY GIVEN that the Board of Education of the Rush-Henrietta Central School District will hold a public hearing for the purpose of presenting the proposed school district budget for the fiscal year of the said school district beginning July 1, 2020, and ending June 30, 2021, such hearing to be held remotely pursuant to Executive Order No 202.26, on Tuesday, May 26, 2020, beginning at 7 p.m. For instruction on viewing the meeting, please visit the district website at www.rhnet.org. NOTICE IS ALSO HEREBY GIVEN that pursuant to Executive Order 202.26, the annual election of the Rush-Henrietta Central School District for the purpose of voting upon the proposition authorizing the appropriation of the necessary funds to meet the estimated expenditures for the fiscal year beginning July 1, 2020, and ending June 30, 2021, and upon the levy of taxes, or any other propositions, and also for the purpose of voting upon the election of three members to the Board of Education, will be held remotely on Tuesday, June 9, 2020, by absentee ballot only.
NOTICE IS FURTHER GIVEN that qualified voters of the school district shall be entitled to vote by absentee ballot, as provided below, at the annual vote and election. A qualified voter is one who is (1) a citizen of the United States, (2) 18 years of age or older, and (3) a resident within the school district for a period of 30 days preceding the vote and election.
NOTICE IS FURTHER GIVEN that a proposition will be presented as to the establishment of a reserve fund for the purpose of construction, reconstruction, rehabilitation, repair and equipping of school buildings, and facilities and site improvements in accordance with Education Law Section 3651, to be designated as the 2020 Capital Reserve Fund, over a probable term of 10 years, but to continue for its stated purpose until liquidated according to Education Law or until its funds are exhausted, the ultimate amount of such fund to be $18,000,000, the source of which shall be determined by the Board of Education including any and all state aid and any and all federal and state funds available by grant or otherwise generated by projects for construction, renovation, reconstruction, rehabilitation or repair of school facilities, any identified General Fund balance, any identified surplus funds in previously established capital reserve funds, other reserve funds, and interest earnings.
Pursuant to Executive Order 202.26, two absentee ballots, together with a postage-paid return envelope, will be sent to every household, enabling any qualified voter to cast a ballot for the election of members to the Board of Education and the adoption of the annual budget and referenda. Parker Administration Building, 2034 Lehigh Station Road, Henrietta, NY 14467, by 5 p.m. prevailing time on June 9, 2020.
Military voters – a qualified voter of New York state, who is in actual military service, and is absent from the district on the day of the election or is discharged from service within 30 days of an election; or a spouse, parent, child, or dependent of such service member who is a qualified voter and is absent due to the service of the military member – may request a ballot application for the election via mail, fax, or e-mail at the school district clerk’s office, 2034 Lehigh Station Road, Henrietta, NY 14467; 585-359-5045 (fax); or email@example.com. Such application must be received by the school district clerk at least 25 days before the election, if the ballot is to be mailed to the voter. A list of all persons to whom a military voter’s ballot shall have been issued shall be filed in the school district clerk’s office and shall be available for public inspection during regular office hours until the day of the election. The military ballot must be received by the school district clerk no later than 5 p.m. on the day of election in order to be canvassed.
NOTICE IS FURTHER GIVEN that a statement of the estimated expenses for the fiscal year beginning July 1, 2020, and ending June 30, 2021, together with the text of any propositions or resolutions which will be presented to the voters at the election to be held June 9, 2020, will be completed and made available upon request to any qualified voter during the 14 days immediately preceding such election, except Saturday, Sunday or holidays, by e-mailing firstname.lastname@example.org. A copy of the budget and attachments also will be posted to the district website at www.rhnet.org.
NOTICE IS FURTHER GIVEN that petitions nominating candidates for the office of member of the Board of Education must be filed with the school district clerk between the hours of 9 a.m. and 5 p.m. no later than Monday, May 11, 2020. Each petition shall be directed to the school district clerk and must be in accordance with New York State Executive Order No. 202.26, which states there is no minimum threshold of signatures required on nominating petitions for this election, provided, however, an individual must meet any other requirements necessary to be placed on the ballot, including any applicable residency and age requirements.
There are three seats on the Rush-Henrietta Central School District Board of Education up for election. The two candidates receiving the highest number of votes will each be elected for a three-year term beginning July 1, 2020, and ending June 30, 2023. The next candidate receiving the highest number of votes will be elected to serve a term beginning upon the filing of the oath of office and ending June 30, 2021.
