LEGAL NOTICE NOTICE OF ANNUAL PUBLIC HEARING, BUDGET VOTE AND ELECTION, OF THE EAST ROCHESTER UNION FREE SCHOOL DISTRICT, TOWN OF EAST ROCHESTER, COUNTY OF MONROE, STATE OF NEW YORK NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the East Rochester Union Free School District, Monroe County, East Rochester, New York, will be held virtually on May 26, 2020 at 7:00 PM prevailing time, for the presentation of the budget. Information regarding virtual attendance will be posted on the District’s website at: http://www.erschools.org. RESOLVED, that the annual meeting of the qualified voters of the East Rochester Union Free School District of the Town of East Rochester, Monroe County, New York, will be held remotely on June 9, 2020 (every eligible voter will be sent an absentee ballot with a postage paid return envelope) for voting by absentee ballot upon the following items and propositions: 1. To adopt the annual budget of the School District for the fiscal year 2020 - 2021 and to authorize the requisite portion thereof to be raised by taxation on the taxable property of the District 2. To elect two (2) members of the Board for a three (3) year term, commencing July 1, 2020 and expiring on June 30, 2023 to succeed Mrs. Jennifer Majewski Lesinski and Mr. Matt Hogan whose terms expire on June 30, 2020. AND FURTHER NOTICE IS HEREBY GIVEN that absentee ballots must be received by the District Clerk (222 Woodbine Avenue, East Rochester, NY 14445) no later than 5:00 PM, prevailing time, on June 9, 2020. AND FURTHER NOTICE IS HEREBY GIVEN that a copy of the statement of the amount of money which will be required to fund the School District’s budget for 2020 - 2021, exclusive of public monies, may be obtained by any resident of the District during the fourteen (14) days immediately preceding the vote on the District website http://www.erschools.org/. If you are unable to access the statement from the District website, please contact the District Clerk. AND FURTHER NOTICE IS HEREBY GIVEN that petitions nominating candidates for the office of member of the Board of Education shall be filed with the Clerk of said School District at his/her office not later than May 11, 2020 by 5 PM, prevailing time. Each petition shall be directed to the Clerk of the District and must state the name and residence of the candidate. AND FURTHER NOTICE IS HEREBY GIVEN, FURTHER NOTICE IS HEREBY GIVEN, that military voters or a spouse, parent, child or dependent of a voter as described above, accompanying or being with such voter who are qualified voters of the School District may apply for a military ballot by requesting an application from the District Clerk at (585) 248-6302 or kristen.adler@erschools.org as soon as possible, as military ballots must be transmitted by the District by May, 15, 2020. The District Clerk must then receive the military voter’s military ballot by mail or in person not later than 5:00 p.m. on June 9, 2020. In a request for a military ballot application or ballot, the military voter may indicate his/her preference for receiving the application or ballot by mail, facsimile transmission or electronic mail. AND FURTHER NOTICE IS HEREBY GIVEN, A list of persons to whom absentee ballots are issued will be available for inspection upon request to the District Clerk on the day of the election and on each of the 5 days preceding. Any qualified voter may object to the voting of the ballot upon appropriate grounds for making his/her challenge and the reasons therefore known to the Inspector of Election before the close of the vote. AND FURTHER NOTICE IS HEREBY GIVEN, that the qualified voters of the School District shall be entitled to vote at said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen years of age or older, and (3) resident within the School District for a period of thirty (30) days preceding the annual vote and election. AND FURTHER NOTICE IS HEREBY GIVEN, that pursuant to a rule adopted by the Board of Education in accordance with §2035 and §2008 of the Education Law, any referenda or propositions to amend the budget, otherwise to be submitted for voting at said election, must be filed with the Clerk of the Board of Education at the Superintendent’s Office on or before May 11, 2020 at 4:00 PM prevailing time; must be typed or printed in English, must be directed to the Clerk of the School District and must state the name and residence of each signer. However, the School Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the expenditure of monies is required by proposition. BE IT RESOLVED, that the Board of Education empowers the Superintendent of Schools to make changes to the 2020-2021Budget Legal Notice in accordance with the guidance set forth by the State of New York as the dates become available.
